Convicted killer doesn't want competency hearing that could remove him from death row

WOOD COUNTY, Ohio — A man convicted of a 2007 double murder in Perrysburg Township and sentenced to death is scheduled to have a hearing that could lead him to be removed from death row.

Calvin Neyland, now 60 years old, was convicted in 2008 of shooting and killing Douglas Smith and Thomas Lazar at Liberty Trucking. He has been on death row since.

An attorney for Neyland, David Klucas, said that a change in state law allows people sentenced to death to request a competency hearing. The attorney has filed a request to hold that hearing that could change his sentence to life in prison.

The attorney said Neyland does not want that hearing to take place. On Monday, a separate hearing is scheduled to determine if Neyland is competent to make that decision.

If Neyland is determined to not be competent during Monday's hearing, his attorneys could move forward with efforts to remove him from death row.
