TOLEDO, Ohio — The suspect accused of shooting a man and a 2-year-old boy in west Toledo earlier this month has been indicted by a Lucas County Grand Jury.

Ethan Smith, 19, was indicted on the following charges:

  • Five counts of felonious assault
  • One count of improperly discharging firearm at or into habitation
  • One count of discharge firearm on or near prohibited premises
  • One count of improperly handling firearms in motor vehicle
  • One count of having weapons while under disability

Smith is accused of shooting both victims — the 2-year-old in the head and the 20-year-old man in the leg — on Sept. 5 around 10:45 p.m. inside a home on Mackow Drive in the Scott Park neighborhood.

An area resident WTOL 11 spoke with the day after the shooting said they saw a dark SUV driving down the street and a person releasing rounds from the sunroof.

Following the shooting, Toledo police said the 2-year-old was hospitalized in critical condition.

At least two vehicles were also struck in the shooting, according to police, and dozens of casings were seen scattered in the street on Mackow Drive.
